Am I Eligible for Workers’ Comp in Florida?

While some exceptions can apply, most Florida employers are required to carry workers' compensation coverage, meaning that most employees should be eligible for workers' compensation benefits after a covered incident. Keep in mind that the eligibility requirements vary between industries. 

Below is an overview of workers’ compensation eligibility by industry

  • Construction Industry: All construction-related employers must carry workers' compensation, regardless of how many employees they have on staff. There are few exceptions to this, although some construction employers may be eligible to file an owner’s exemption depending on the circumstances. 
  • Non-Construction Industry: Non-construction employers with four or more employees must carry workers' compensation, including full-time and part-time workers. 
  • Agricultural Industry: Agricultural employers with six or more workers are required to have workers’ compensation coverage. Alternatively, the same mandate applies to those with at least twelve seasonal workers employed.
