How Long Do I Have to File a Wrongful Death Lawsuit in Florida?

In the state of Florida, there is a time limit for filing a wrongful death claim. This is known as the “statute of limitations.” Under Florida law, the statute of limitations for wrongful death is two years from the date of the victim’s death. In some cases, the statute of limitations may be “tolled,” or extended, for a period of time.

For example, the statute of limitations may be tolled if:

  • The personal representative of the deceased’s estate was not aware that the death was caused by the negligence or wrongful actions of another party
