What is Premises Liability?
Premises liability is an area of personal injury law that involves injuries sustained on someone else’s property. This includes both residential and commercial properties. In a premises liability claim, the injured party (the “plaintiff”) alleges that the property owner (the “defendant”) was negligent in maintaining the property, which led to a dangerous or hazardous condition that caused the plaintiff’s injuries.
What Are the Basics of Premises Liability Law?
Like other personal injury claims, premises liability claims require the plaintiff to prove that the defendant was negligent in some way. In the context of premises liability, this means proving that the property owner failed to maintain the property, failed to inspect the property, or failed to take reasonable steps to address a dangerous condition on the property.
In order to have a viable premises liability claim, you must be able to prove the following:
- The defendant owned, occupied, or controlled the property
- The defendant was negligent in maintaining the property, inspecting the property, or addressing a dangerous condition on the property
- You were lawfully on the property (i.e. you were not trespassing)
- You suffered injuries/damages
In some cases, the property owner’s negligence is not the only relevant factor. For example, if you were injured on someone else’s property and you were partially at fault, you may still be able to file a premises liability claim. This is because Florida adheres to a pure comparative negligence rule. Under this rule, you can still recover compensation even if you were up to 99 percent at fault for your injuries. However, your total recoverable damages will be reduced by your own percentage of fault.
