Car Accident Laws in Florida
Florida operates under a no-fault insurance system for car accidents. This means that after a car accident, drivers must first turn to their own insurance coverage, regardless of who was at fault. Personal Injury Protection (PIP) insurance covers medical expenses and, in some cases, lost wages, regardless of fault. However, there are exceptions to this rule for cases involving serious injuries or significant damages.
Here's a closer look at these exceptions:
- Serious Injuries: Florida law defines "serious injuries" as those resulting in significant and permanent loss of an important bodily function, permanent injury within a reasonable degree of medical probability, significant and permanent scarring or disfigurement, or death. In cases where injuries meet these criteria, the injured party can step outside of the no-fault system and pursue a claim against the at-fault driver for additional damages, including medical expenses, lost wages, pain and suffering, and other related losses.
- Significant Damages: Even if injuries may not meet the threshold for "serious injuries," if the total damages resulting from the accident exceed the limits of the injured party's PIP coverage, they may still be able to pursue a claim against the at-fault driver's insurance company or file a lawsuit for compensation beyond what is covered by PIP. These damages can include medical expenses, lost income, property damage, and pain and suffering.
Florida also follows a pure comparative fault system. This means that even if you were partially at fault for the accident, you can still recover damages. However, the amount of compensation you receive will be reduced by your percentage of fault. For example, if you were found to be 20% at fault for the accident, your compensation would be reduced by 20%.
